This Website contains comedic notices, which are not to be taken literally. In particular, all content within the Comedy sections of this website are satirical, and not the report of actual facts. By using this website, you agree to indemnify and hold harmless zkeletenz.com and its owners from any claims related to any alleged false reporting of facts, or related, dignitary claims. You may not re-report or otherwise broadcast any content within the Comedy sections of this website as fact.

PRIVACY

Zkeletenz collects and maintains certain limited information concerning your use of the zkeletenz website, including the identity of your internet protocol address to determine web traffic and the number of unique visitors. In subsequent versions of the zkeletenz websites, we may collect further demographic information and aggregate information concerning preferences and popularity of particular websites among users in general. At all times, your individual privacy as a user is carefully protected and zkeletenz will never provide or sell identifying information to third parties concerning its users.

LINKS TO OTHER WEBSITES PROVIDED ON ZKELETENZ

While zkeletenz goes to great effort to collect and maintain information concerning the location of useful and popular websites with relevancy to particular subject areas, it cannot (and no web information company can) be assured of discovering every such useful and/or popular website. As such, zkeletenz maintains information concerning other websites and provides that information on an "as is" basis, with no warrantees, including any warrantees of merchantability or fitness for a particular purpose, and assumes no responsibility for its acuracy or completeness. The method by which zkeletenz collects links to websites according to their popularity and/or expert opinion is complex and proprietary, but involves both automated technical process and human analysis. By providing links to websites titled as "by popularity," zkeletenz is not warranting or representing that such websites definitely have the greatest amount of web traffic, viewing time, number of in-bound links or unique visitors over any particular length of time. No web information company can make such a representation, since no such data or method is universally accepted as a correct evaluation of what websites are the most "popular." Rather, lists of popular websites represent, in part, an overall human evaluation of the general "buzz" over particular websites and, in part, are weighted according to relevancy to a particular subject area. For example, a more popular website by some traffic measure or by overall buzz may be ranked lower than another website if that more popular website has only one subsection dedicated to that subject area.

Similarly, by providing links to websites titled as "by expert opinion," zkeletenz is not warranting or representing that such websites definitely have the most usefulness to users, or that any particular accredited or recognized expert has adjudged or certified their excellence. While the zkeletenz team pays great attention to the opinions of recognized experts and feedback from users, the presence of a link to a particular website on a list titled as "by expert opinion" signifies only that panel members at zkeletenz have adjudged those websites to be particularly helpful and/or experientially superior overall for users.

Zkeletenz welcomes feedback from users concerning whether links to websites provided on any page at zkeletenz is appropriate or ranked properly. In addition, zkeletenz reserves the right to summarily restrict access to any user that uses its services illegally, in bad faith, against its usage policies or otherwise inappropriately. Zkeletenz does not, and no web information company can, be responsible for monitorring or controlling all conduct of its users. Zkeletenz may investigate such activities and report such information to authorities, particularly in compliance with authoritative process, such as subpoenas or court orders. Zkeletenz may disclose user information that it has gained through users’ use of zkeletenz in the course of such investigations and compliance. Use of the information concerning websites provided on zkeletenz (the "information") is protected by copyright, including the law covering derivative works. Use of the information is permitted by zkeletenz users only, and may not be copied and re-listed without specific, express, written permission from zkeletenz.

REQUEST DEPOSTING OF A WEBSITE ON ZKELETENZ

Without more specific information from a website publisher, zkeletenz understands that by publishing a website on the world wide web, a website publisher intends the existence and location of that website to be publicly available information. Accordingly, zkeletenz believes that by its posting of a link to such websites, it is honorring the wishes of the website publisher. If you discover that a website that you own and intended to remain private has been made available in a link on zkeletenz, you may request its deposting at the following e-mail address: zkeletenz@gmail.com. Proof of website ownership must be supplied prior to deposting any link pursuant to such request.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless zkeletenz, and each of its officers, directors, employees, agents, information providers and licensors from any claims, costs, losses, damages, judgments and expenses, including but not limited to reasonable attorney's fees, relating to or arising out of any breach of this Agreement or any use of zkeletenz by you, or by any other person using zkeletenz through you or by using your property.

APPLICABLE LAW

The terms and enforcement of this Agreement is governed by the laws of the State of Connecticut, without regard to its conflict of laws principles.

SEVERABILITY

If any aspect or part of this agreement is determined to be void or unenforceable under law, the remaining parts and sections of this agreement shall be upheld as severable.

LIMITATION OF LIABILITY

In addition to the limitations discussed above, you agree to hold zkeletenz harmless of any consequential, unforeseen, or punitive damages arizing from your use of this website and its contents.

MERGER

This Agreement is the entire understanding among the parties and parole or other information shall not be admissible to establish different terms to this agreement.
